Terms of use

The terms for using Summit Fever, from account rules to mountain safety.

Terms version 1.0.0 · Effective date: 2026-10-15

Please read section 5 (Safety) carefully. Summit Fever is a logbook and planning tool, not a safety device. Mountain activities are dangerous and you decide, and are responsible for, how you undertake them.

In short (this summary does not replace the Terms below):

  • Summit Fever is a logbook and planning tool, not a safety, rescue or emergency service.
  • You decide how you undertake your outdoor activities and remain responsible for your own safety.
  • Keep your account secure. You keep ownership of the content you upload.
  • If you join the community, other members can see your activity; follow the Community Guidelines.
  • You can delete your account at any time; uninstalling the app alone does not delete it.
  • From the beta version we offer optional paid products, such as carabiners, one-time unlocks and subscriptions. You see the full price before you pay.
  • Subscriptions renew automatically until you cancel them in your App Store or Google Play settings. Deleting your account does not cancel a subscription.
  • These Terms never limit the mandatory rights you have as a consumer.

1. About these Terms

1.1 These Terms of Use ("Terms") are a contract between you and Giambattista Salvi, Madrid, Spain, NIF/NIE Y8662110W ("Summit Fever", "we", "us"), for the Summit Fever mobile app and related services (the "Service"). Contact: support@summitfever.app.

1.2 These documents form part of the Terms: the Safety, Navigation & Assumption of Risk Notice; the Community Guidelines & Moderation Policy (if you use Expedition), including our child safety standards (https://summitfever.app/legal/community.html); the Carabiners & Offline Route Terms (if you use carabiners); and the Official Rules of any challenge you join. The more specific document prevails on its subject.

1.3 Our Privacy Policy (https://summitfever.app/legal/privacy.html) explains how we process personal data. It is information only: accepting these Terms does not mean you consent to optional processing. Where we need your consent, we ask for it separately.

2. How the contract is concluded

2.1 You conclude the contract by entering your details (or choosing Google or Apple sign-in), ticking the box confirming your age and accepting these Terms, and tapping "Create account". Before you tap the button you can review and correct your details.

2.2 We store the version of the Terms you accepted and the time of acceptance. You can view the current version at any time at https://summitfever.app/legal/terms.html and in the app, and request a copy of the version you accepted.

2.4 The basic Service is free of charge. From the beta version of the app, we offer optional in-app purchases (section 13). Before any purchase, the app shows what you are buying and the total price, including taxes, and you confirm the purchase through the app store.

3. Definitions

  • Account: your personal Summit Fever account.
  • Carabiners: the virtual units described in the Carabiners & Offline Route Terms.
  • Community or Expedition: the social features of the Service.
  • Consumer: an individual acting for purposes outside their trade, business or profession.
  • User Content: content you submit, such as your display name, profile photo, summit logs, notes and reports.

4. Eligibility and your Account

4.1 You must be at least 14 years old. Prize challenges may require you to be 18.

4.2 Your registration details must be accurate. You may hold one Account, which is personal and not transferable.

4.3 Keep your login credentials confidential and tell us at support@summitfever.app if you suspect misuse. You are responsible for activity on your Account unless it was caused by circumstances outside your control.

4.4 If you use Google or Apple sign-in, their terms also apply to the sign-in.

4.5 Data stored only on your device (such as saved route details and offline maps) can be lost if you lose the device or uninstall the app. Signing out does not delete data from your device.

4.6 Uninstalling the app does not delete your Account. To delete it, use the option in the app or follow the instructions at https://summitfever.app/delete-account.

5. Safety: what the Service is and is not

5.1 Purpose. Summit Fever helps you discover peaks, plan routes, log summits, track achievements and share activity. It is not an emergency device, survival aid, rescue service, certified navigation instrument, weather or avalanche service, or a guarantee that a route is safe, open, passable or suitable for you.

5.2 No emergency function. The Service does not alert rescuers or other people and does not monitor you. In an emergency, call 112, or in Switzerland also 1414 (Rega).

5.3 Your decisions. You decide whether, when and how to undertake an outdoor activity and when to turn back. You are responsible for assessing conditions, your fitness, skills and equipment; checking official weather, avalanche and closure information; carrying suitable equipment including a map and compass; and complying with laws, access restrictions and protected-area rules.

5.4 Inherent risks. Hiking, scrambling and mountaineering involve risks that exist regardless of the Service, including falls, rockfall, avalanches, sudden weather changes, lightning, extreme temperatures, darkness, exhaustion, altitude illness, getting lost, animals, and the lack of help or mobile coverage. You acknowledge these risks and that assessing and managing them is your responsibility. The Safety Notice forms part of these Terms.

5.5 Challenges and badges are never a reason to take risks. Stop in a safe place before using your phone or camera, including for summit photos.

5.6 This section describes what the Service does and the responsibilities that remain with you. It does not exclude or limit our liability under the law for our own conduct or for defects of the Service (section 17).

6. Location, GPS and navigation

6.1 Location features depend on your device's GPS, sensors, battery, settings, satellite reception and, for some functions, a network connection. Positions and altitudes can be inaccurate by tens of metres or more, especially in steep terrain, forests, valleys and bad weather.

6.2 Route guidance, off-route alerts, remaining distance and elevation figures and arrival detection are aids. They can be delayed, inaccurate or unavailable, for example when the app shows a plain background because map data is missing.

6.3 Offline availability depends on a successful download, storage space and your device. Check offline maps and routes before you set out.

7. Peak, trail and map data

7.1 Peak, trail and map data come from third-party and community sources, especially OpenStreetMap, and from our processing. They may be incomplete, outdated or wrong, and trails may be closed, rerouted or impassable.

7.2 Difficulty ratings (e.g. the SAC hiking scale), visibility, waymarking and surface information are indicative, not official assessments, and do not reflect current conditions.

7.3 When you combine trails into a route, the app does not check whether the combination connects safely or suits you.

7.4 Map data © OpenStreetMap contributors, under the Open Database License. Further attributions: Profile → Legal → Open-source licences.

7.5 Elevation totals in the app are calculated from catalogue elevations of logged peaks, not measured ascent.

8. Summit logs and verification

8.1 Only log summits you actually reached in person.

8.2 The app applies automatic plausibility checks, which may differ depending on how a summit is logged. A logged summit is not proof or an official record.

8.3 Location spoofing, device manipulation or other falsification is prohibited. We may flag, exclude or remove logs we reasonably believe to be false and take measures under section 15.

9. Achievements and challenges

9.1 Badges, XP, levels, ranks and streaks have no monetary value, cannot be exchanged for carabiners or money, and are not transferable. We may recalculate them to correct errors or reflect changes to our peak catalogue or rules.

9.2 Challenge progress shown in the app is provisional until confirmed by our servers. A prize is offered only where a challenge has published Official Rules, which then govern eligibility, verification, winners and prizes. Prize challenges are always free to enter, never require carabiners, a purchase or a subscription, are always open to users who have not bought anything, and are open only to residents of the countries named in their Official Rules (see section 21.B.5 for Italy).

10. The Expedition community

10.1 To use Expedition you must accept the Community Guidelines. Your community activity then becomes visible to your followers, as described in the Privacy Policy.

10.2 You can stop taking part at any time by deleting your Account in the app.

10.3 You can report content and users, and block users (in both directions).

11. Your User Content

11.1 You keep ownership of your User Content.

11.2 You grant us a non-exclusive, worldwide, free-of-charge licence, for as long as the User Content is stored in the Service, to host, store, reproduce, technically adapt (e.g. resize), display and make available your User Content, solely to operate, secure and improve the Service and in line with your settings. The licence ends when the content is deleted, except for copies we must keep for legal reasons and copies already shared by other users.

11.3 We will not use your photos or name in advertising outside the Service without your separate permission.

11.4 You confirm that you have the necessary rights to your User Content, including the consent of identifiable people in photos, and that it does not infringe third-party rights or the law.

11.5 We screen display names and profile photos automatically before they are shown to others and may moderate User Content (section 15). We have no general obligation to monitor User Content.

12. Acceptable use

You must not:

  • break the law or post illegal, hateful, harassing, threatening, sexual, violent, defamatory or misleading content;
  • impersonate others, or create multiple or fake Accounts;
  • falsify summit logs, spoof your location, or manipulate challenges, rankings or carabiner balances;
  • publish other people's personal data or live whereabouts without their consent;
  • encourage illegal or dangerous behaviour, such as trespassing, entering closed or protected areas or disturbing wildlife;
  • reverse-engineer or interfere with the Service beyond what mandatory law allows, circumvent security or rate limits, or use bots or scrapers;
  • extract data in bulk or use the Service to build a competing product;
  • send spam or advertising, or misuse the reporting system.

13. Purchases, subscriptions, carabiners and offline routes

13.1 Paid offers. From the beta version of the app, we may offer optional paid products, for example:

  • carabiner packages;
  • one-time purchases that unlock features or content, such as route or map packs, or lifetime access to premium features;
  • premium subscriptions with recurring billing;
  • promotional offers, such as free trials, introductory prices and discount or redemption codes.

The basic Service remains available free of charge. The app describes which features are included in the free version and in each paid offer. Offers, their content and prices may differ by country and platform and may change over time.

13.2 How you pay. In the app, purchases are made through the Apple App Store or Google Play. Payment, payment methods, billing and receipts are handled by Apple or Google under their terms. For tax purposes the app store acts as seller, but we remain responsible for providing what you bought. We never receive your payment card details.

13.3 Prices. Before you confirm a purchase, the app or checkout page shows the product and the total price in your local currency, including VAT and any other taxes. Prices may differ by country, platform, sales channel and promotion. Price changes do not affect purchases already completed; price changes for running subscriptions follow section 13.10.

13.4 Delivery and restoring purchases. What you buy is made available in your account once we receive confirmation of payment. You can restore purchases on a new device with the "Restore purchases" option, using the same store account. If a completed payment is not delivered, contact support@summitfever.app with your receipt, and we will deliver the purchase or help you obtain a refund.

13.5 Promotional offers. Free trials, introductory prices and codes are subject to the conditions shown with the offer, such as eligibility, duration and expiry. Unless stated otherwise, each offer can be used once per person, and codes cannot be exchanged for cash.

13.6 Family sharing. Where a purchase can be shared through Apple Family Sharing or Google Play Family Library, family members can use it under the app store's rules.

13.7 One-time purchases. Features or content you buy with a one-time purchase remain available for as long as your Account exists and we offer the Service. "Lifetime" access means for the lifetime of the Service for your Account. If we discontinue a feature or content you bought with a one-time purchase, we give at least 60 days' notice and offer an equivalent feature or content or a proportionate refund, as the law requires.

13.8 Right of withdrawal and refunds. Consumers in the EU/EEA have a 14-day right of withdrawal from purchases, as set out in section 22:

  • for digital content supplied immediately, such as carabiners and one-time unlocks, the right ends when supply starts with your express agreement and your acknowledgment that you lose the right;
  • for subscriptions, you can withdraw within 14 days of subscribing; if you asked for the subscription to start immediately, you pay a proportionate amount for the period until you withdraw;
  • if you cancel during a free trial, you pay nothing.

Refunds for app store purchases are processed by Apple or Google under their procedures. None of this limits your statutory rights against us, including your rights if a purchase does not conform to the contract. Consumers in Switzerland: see section 21.C.

13.9 Minors. If you are under 18, you need the permission of a parent or guardian to make purchases. We recommend that parents use the purchase controls offered by Apple and Google.

13.10 Subscriptions.

13.10.1 Before you subscribe, the app shows the subscription's content, price, billing period, any trial or introductory price, and renewal terms.

13.10.2 Subscriptions renew automatically at the end of each billing period at the price shown, unless you cancel at least 24 hours before the period ends. You cancel in your App Store or Google Play account settings or, for subscriptions bought on our website, in your account on the website. Cancellation takes effect at the end of the current billing period; there is no refund for the remaining part of a period, except where the law or the app store's refund policy provides otherwise. Deleting your Account or uninstalling the app does not cancel a subscription.

13.10.3 A free trial or introductory price converts into the regular paid subscription at the end of the trial or introductory period unless you cancel before then. The app tells you the trial length and the price that will then apply.

13.10.4 We inform you at least 30 days in advance of a price increase. Where the law or the app store requires it, the increased price applies only if you agree to it; otherwise you can cancel before it takes effect.

13.10.5 If a renewal payment fails, the app store may give you a grace period during which premium features remain available. If payment is not completed, the subscription ends.

13.10.6 We may develop and change the premium features. Section 16.4 applies to changes that negatively affect a subscription you have paid for.

13.10.7 When a subscription ends, premium features stop, but your logbook and other data remain available in the free version of the Service.

13.11 Refunds and chargebacks. If Apple, Google or our payment provider refunds a purchase, or a payment is reversed, we may remove the corresponding items or end the corresponding subscription. Fraudulent refund requests or chargebacks are a breach of these Terms.

13.12 Carabiners and offline routes. Carabiners and the offline routes you unlock with them are governed by the Carabiners & Offline Route Terms. In short: carabiners have no monetary value, cannot be cashed out or transferred, and unlocked routes can be re-downloaded while your Account and the Service exist. Subscriptions or other offers may include carabiners, as described in the offer.

13.13 Sponsored content and partner offers. The Service may include sponsored challenges, partner offers or other commercial content. Such content is always clearly identified as commercial. We do not use your personal data for personalised advertising without your consent.

14. Intellectual property

14.1 The Service, including software, design, the Summit Fever name and logo, badge artwork and our data compilations, belongs to us or our licensors.

14.2 We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for private, non-commercial purposes, in line with these Terms and the app store rules.

14.3 Open-source components are subject to their own licences, listed in the app; these Terms do not restrict rights you have under them.

14.4 We may use feedback you send us without obligation.

15. Moderation, suspension and termination

15.1 Measures. If we reasonably believe that you have breached these Terms, the Community Guidelines or the law, we may, proportionately: remove or hide content; reject a name or photo; exclude summit logs from challenges; restrict features; suspend your Account; or terminate it. We take into account severity, frequency, consequences and your explanations.

15.2 Reasons and review. We tell you what we did and why, unless the law prohibits it or it would endanger someone, and you can ask us to review the decision as described in the Community Guidelines (identify the account and decision concerned, and do not send us harmful material). You may also use the courts and other remedies available under the Digital Services Act.

15.3 By you. You can stop using the Service and delete your Account at any time.

15.4 By us. We may terminate these Terms on 60 days' notice, or immediately for serious or repeated breaches or where required by law. If we discontinue the Service, we give at least 60 days' notice.

15.5 Effect. On termination your right to use the Service ends and your data is handled as described in the Privacy Policy. Sections 11.4, 14, 17 and 20 survive.

16. Availability, updates and changes

16.1 The Service is currently in early access. Features may be incomplete or change, and errors are more likely than in a mature product. Paid features in an early-access version are fully covered by your statutory rights.

16.2 We aim to keep the Service available but cannot guarantee uninterrupted operation; maintenance, networks and third-party services may affect it.

16.3 You have the statutory rights that apply to digital content and digital services, including a Service that conforms to the contract and the updates, including security updates, needed to keep it conforming.

16.4 We may change the Service for valid reasons, such as new features, security, or legal or technical requirements. We will inform you in advance of changes that negatively affect your use more than minimally. Where such a change affects a paid feature, you may terminate the relevant contract free of charge within 30 days of the information or the change, whichever is later.

17. Liability

17.1 We are liable in accordance with the applicable statutory provisions, including for defects of the Service and under product liability law. Nothing in these Terms excludes or limits our liability towards consumers where the law does not allow this.

17.2 In line with sections 5 to 7, the Service is a planning and logbook tool. Loss caused by your own decisions and conduct outdoors, by natural hazards, weather and terrain, by the failure of your own device, battery or network, or by the conduct of other users or third-party services is not attributable to us, unless it was caused by a breach of our own obligations.

17.3 Section 21 contains additional rules for users in Spain, Italy and Switzerland.

17.4 You are not required to waive any rights available to you under the law of your country of residence.

18. Your responsibility

If you culpably breach these Terms or the law through your use of the Service and a third party claims against us as a result, you must compensate us for the resulting damage and reasonable costs, in accordance with the law.

19. Changes to these Terms

19.1 We may change these Terms for valid reasons, such as changes in the law or case law, new features, security requirements or clarifications. We will inform you in the app at least 30 days before material changes take effect. Material changes apply to you only once you have expressly accepted them in the app; we never treat silence or continued use as acceptance of a material change.

19.2 If you do not accept a material change, you may delete your Account free of charge; until you do, we may restrict features that depend on the new terms. Minor changes that do not disadvantage you (for example corrections or clarifications) take effect on notice. Changes do not apply retroactively and cannot change the essential elements of the contract to your disadvantage without your consent.

20. Applicable law and disputes

20.1 These Terms are governed by Spanish law, excluding the UN Convention on Contracts for the International Sale of Goods.

20.2 Consumers resident in the EU/EEA keep the protection of the mandatory provisions of the law of their country of residence and can bring proceedings in the courts of their domicile; we can sue consumers only there.

20.3 Complaints. Please contact us first at support@summitfever.app; we aim to answer within 15 days. We do not currently participate in consumer alternative dispute resolution proceedings.

21. Country-specific provisions

This section supplements the rest of these Terms for users in Spain, Italy and Switzerland. If it conflicts with another section, this section prevails for users in that country.

21.A Consumers in Spain

21.A.1 Your contract is governed by Spanish law, including the consolidated General Law for the Protection of Consumers and Users (TRLGDCU) and the law on general contract terms (Ley 7/1998). Clauses that the law considers unfair are void and do not bind you.

21.A.2 You can bring proceedings in the courts of your domicile, and we can sue you only there.

21.A.3 Besides contacting us, you can contact the consumer protection authorities of your autonomous community or your municipal consumer information office (OMIC).

21.B Consumers and users in Italy

21.B.1 Mandatory law. If you are a consumer habitually resident in Italy, you keep the protection of the mandatory provisions of Italian law, in particular the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005). Clauses considered unfair under Articles 33 to 36 of the Consumer Code are void and do not bind you.

21.B.2 Courts. The court of the place where you reside or are domiciled has jurisdiction for disputes with consumers (Article 66-bis of the Consumer Code).

21.B.3 Withdrawal and conformity. Your right of withdrawal (section 22 and Annex A) and your rights to a Service that conforms to the contract for digital content and digital services apply in accordance with the Consumer Code.

21.B.4 Out-of-court resolution. You may use the alternative dispute resolution procedures provided for in the Consumer Code. We do not undertake to participate in such procedures.

21.B.5 Prize challenges. Prize challenges are not open to residents of Italy unless their Official Rules expressly state that the challenge complies with the Italian rules on prize promotions (Presidential Decree 430/2001).

21.C Consumers in Switzerland

21.C.1 If you are a consumer habitually resident in Switzerland, your contract with us is governed by Swiss law, and you can bring proceedings in the Swiss courts at your domicile; we can sue you only there.

21.C.2 Swiss law does not provide a statutory right of withdrawal for this contract. You can end it at any time by deleting your Account.

21.C.3 Liability. We are liable without limitation for intent and gross negligence, for death and personal injury, and under the Swiss Product Liability Act. Otherwise, to the extent permitted by Art. 100 and 101 of the Swiss Code of Obligations, our liability for slight negligence is excluded.

21.C.4 The other provisions of these Terms apply to the extent compatible with mandatory Swiss law.

22. Right of withdrawal (EU/EEA consumers, including Spain and Italy)

22.1 You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded (the day you create your Account).

22.2 To exercise it, inform us (Giambattista Salvi, Madrid, Spain, support@summitfever.app) by a clear statement, for example an email. You may use the model form in Annex A, but you don't have to. The simplest way is to delete your Account in the app.

22.3 Effects: as the basic Service is free, withdrawing from the account contract involves no refund. If you withdraw from a purchase for which you have not lost your right of withdrawal (section 13.8), the payment is refunded within 14 days using the original payment method; refunds of app store purchases are processed by Apple or Google. Withdrawal from carabiner purchases is also governed by the Carabiners & Offline Route Terms.

22.4 Subscriptions. You can withdraw from a subscription within 14 days of subscribing. If you asked us to start the subscription during the withdrawal period, you pay an amount proportionate to the period provided until you told us you were withdrawing. If you withdraw during a free trial, you pay nothing.

22.5 Digital content. For carabiners and other digital content supplied immediately, you lose the right of withdrawal once supply starts, if you expressly agreed to immediate supply and acknowledged that you would lose the right. We confirm this to you on a durable medium, such as an email.

23. General

23.1 These Terms and the documents in 1.2 are the entire agreement on the Service.

23.2 If a provision is invalid, the rest remain effective. For consumers, the invalid provision is replaced by the applicable statutory rule.

23.3 We may transfer this contract to a company that takes over the Service without reducing your rights; we will inform you and you may terminate if you do not agree. You may not transfer your rights.

23.4 Official contact points under the Digital Services Act are listed in our Legal Notice.
